Interesting news out of Minnesota this fine Thursday evening: Judge Michael Davis has thrown out the verdict of first lawsuit won by the Recording Industry Association of America(RIAA), over 31-year-old Jammie Thomas, who the RIAA said stole song on Kazaa, blah blah blah. The judge determined that he "erred in instructing jurors how to decide if" the defendant had done as claimed, and that she deserved a new trial. This decision could make things much more difficult for the majors as they bumble and stumble along like dinosaurs, trying desperately to impede the inevitable. Poison the Well - who have never made the same record twice, and somehow have never made a bad record, period - have picked J. Robbins of Jawbox fame to help them craft their newest album. Robbins has been behind the glass for Modern Life Is War, Paint It Black and numerous others. The record should be out May of next year.

Everyone's favourite Metallica-worship band Trivium have posted their new record Shogun on their myspace page. Also, I can't turn on my television to MuchLoud without seeing spots for the record.

Man, I hope this tour comes to town: Madball and Suicidal Tendencies will tour together in December, though ST haven't released new material in almost a decade. Clearly, a new Suicidal album is in the offing.

The band who brought you Where Blood and Fire Bring Rest ten years ago are working on a new album: the legendary, massively-influential Zao are recording new music with Tim Lambesis of As I Lay Dying and producer Daniel Castleman. Guitarist Scotty Mellinger says, "We haven't been on the road since the Demon Hunter and Throwdown tours in 2006, which has given us plenty of time to get our wits about us and to really concentrate on creating the best batch of material we possibly can." The new album will be put out by Ferret in 2009. I have a signed poster from the Liberate tour a decade ago. Zao are awesome. The end.

Something I have to get off my chest: last night I went out to see Bury Your Dead, For the Fallen Dreams and A Ghost Inside on their current tour, and sadly BYD were unable to play, having had a horrific van/trailer accident fifteen minutes outside Ottawa after crossing the Canadian border. A couple members made it out to the show; the rest were in hospital with injuries ranging from lacerations to a broken leg. FTFD and AGI were class acts, every last one in Bury Your Dead gear onstage and selling the band's merch in their stead. A terrible incident, all things considered, and then made worse by this, from an industry news/gossip site, which summarizes the unfortunate events of yesterday, followed by dozens of comments from teenaged children who have never seen suffering, have never seen pain, and obviously have never seen anything but their parents' basement, judging by the intellect and raw, ignorant hatred displayed in the mocking posts. Hey, kids - a message from someone who even at your age, with all of your imperfections and lack of perspective, never acted as you did: f*** you, brat squad. We'll see who's laughing when it's your ass in a sling in hospital somewhere after something like this happens to you. Oh yeah - the rest of us. Best wishes to BYD as they overcome(and they will) this obstacle in their journey.

Perhaps Ottawa's best band - a subjective measure, of course - Buried Inside are finally recording their long-awaited new album. The band have headed to Salem, Massachusetts to record the so-far-untitled record with Converge majordomo Kurt Ballou at his Godhead City studio; guitarist Andrew Tweedy says, "This record isn't heavier, or faster, or more melodic than Chronoclast was. [That album] was recorded almost five years ago, and was written over the course of several years before that, so obviously our tastes and ideas have grown and mutated considerably over that time. This record still sounds very much like Buried Inside, in that it is passionate music with a lot of intensity; however, hopefully that is as close as it gets to records we've released in the past."

Ian Stanger at Black Box sent out a lil' facebookery to inform us all that Alberta pop-rock princes Ten Second Epic have posted new music on their myspace - so get to listenin', fools!

My best friend Dave will be excited with this - Blur's Damon Albarn and animator Jamie Hewlett are doing a new Gorillaz record, due out in 2K9 sometime. [Relevant]

The flick won't be in theatres for a while yet, but the new James Bond theme tune written by Jack White and performed by the blazing hot Alicia Keyes is streaming on the web.

Our thoughts and prayers here at SD headquarters remain with drummer Travis Barker and his friend Adam Goldstein - better known as DJ AM - who, aside from sustaining serious personal injuries in a horrific plane wreck over the weekend, also lost several of their entourage, business parters and associates. MTV's college network mtvU has revealed the nominees for this year's Woodie awards, voted on exclusively by college music fans. Paramore, Tokyo Police Club, Chromeo, Cool Kids, MGMT, Atmosphere and the ubiquitous All Time Low are among the honourees this year; the awards will be handed out November 12th in NYC, broadcast on mtvU.com and elsewhere.

The Departed are new to all of us, but their members certainly are not: dudes from Fall Out Boy and Misery Signals(and by extension the late 7 Angels 7 Plagues) have gotten together with their new project - and they've put some stuff up on the interwebs. Sounds pretty sweet.

Oh, man, blast from the past - SoCal legends Pulley have posted new music, their first new material since 2004! They're putting out an EP on their very own soon called Time Insensitive Material - check out the new tune on myspace.

Just because I loved the old tune 'Stand Up,' I'll make mention of this: A Static Lullaby(who played their last-ever show in their first incarnation right here in Ottawa a few years back) are streaming their entire new album Rattlesnake! on their purevolume page. The record just came out on Fearless.

Weezer just can't get enough of never being quite as good as they used to be, it seems; the band are apparently heading right back into the studio in November to record a new album - this just three months after their last album. Geez, guys, take a breath.

Hey - good music! Bayside are streaming their entire new album Shudder! Ch-ch-check it out!

Check out Comeback Kid's myspace to see a trailer for the band's forthcoming DVD, Through the Noise. The package(CD/DVD> comes out October 14th, and three days later the band headline a big tour here in Ottawa with openers Shai Hulud, Bane and Misery Signals. As Will Smith once said as the Fresh Prince of Bel-Air, that is deeply, deeply dope!

Proof that Noel Gallagher of Oasis deserved the cross-check he received onstage in Toronto earlier this month: the guitarist/opinionated a-hole has written a whole bunch of songs he think could be the theme to the next James Bond film, and spouted off this week about Amy Winehouse being unable to sing any of them because she'll be dead before she can. Nice, Noel. As they say in your native country, sod off. [chartattack]

Kardinal Offishall has been a mainstay of the Canadian urban-music scene for over a decade as an MC and a producer - and finally he's got a hit south of the border; 'Dangerous'(featuring Akon) is all over the radio worldwide, and as my best friend said a few weeks ago, "This is huge for Kardi, eh?"(direct quote). He was on The Tonight Show recently as well, and while his star rises, he insists he ain't about to change. Pounds.

One of the seminalest of seminal '90s bands, Smashing Pumpkins will release a DVD of their reunion show last year called If All Goes Wrong. Included in the two-disc set are an interview with The Who's Roger Pete Townshend(?), live footage of shows in North Carolina and San Francisco and tons more. Should be worth the purchase, I daresay.

The folks at Relevant always have good stuff to report - like this guy. He's gonna take his search for a third wife public on the interwebs because God told him to. Geez.

If you're still sleeping on my man Shad, the pride of London, Ontario(with apologies to Kittie), best be waking up. The Old Prince was in town last night at Algonquin College with Hey Ocean, rocking a small show with a parade of dope tracks from his latest(coincidentally, called The Old Prince). He had to book it home to the GTA after - why? To appear on MuchOnDemand this afternoon in downtown Toronto, that's why. It isn't on Youtube yet, but it soon will be. Get to know this cat - he's on the way up.

I can't say I've heard another of her songs besides the number-one smash 'Smile,' but I liked that song so much I'm willing to give her the benefit of the doubt: Lily Allen will release her sophomore album February 9th - my birthday! She's somehow found time to make another record in between clubbing, drinking/clubbing, fighting with other chicks/drinking/clubbing and clubbing. How 'bout that. [AP.net]

One of the most brutal bands who dig baseball(you had to be there probably), Baltimore's Misery Index are streaming their new record. Expect brutality. BRUTALITY! Oh, and to explain the baseball reference - when the band played here in Ottawa a few years back, our triple-A baseball team(now defunct) was the top farm team of the major-league Baltimore Orioles. Who have been pathetic since this guy retired, but that's beside the point.

MTV's decade-long weekday-afternoon institution Total Request Live is apparently being put in the glue barn at the company's NYC farm(think it through - it will come to you), and I'm trying to remember a single time I ever saw the show. I don't believe such a moment exists, but as a blogger/pop-cult enthusiast it could not be avoided - read one man's opinion of what certainly was groundbreaking television. 'Youtube before Youtube came along'? Perhaps.

According to an NME interview, Foo Fighters will be taking a 'long hiatus' from music - can't fault the band for that; not many stadium-level rock bands have worked their asses off as hard as the Foos since the late '90s. Kick back, gents, you've earned it.

The makers of Guitar Hero must have realized I was growing a little tired of just guitars - they're gonna develop DJ Hero! This is superb news!

Best Buy bought Napster for over a hundred million bucks this week. Wait - people still care about Napster?

Prepping for the release of their major-label debut effort New Surrender, Anberlin(gads I love this band) have launched the new album's website. Go look, and get stoked for the new slab.

If you actually bought the new Metallica record(why? just...why?) and you're sitting in your bedroom doing your trig homework or at the office going over patent applications or whatever the hell it is you do, and you're wondering, 'Why does this sound so horrific?', well, this might explain things. The Guitar Hero version of 'Death Magnetic' apparently sounds far better, due to the album being so heavily compressed that the highs and lows are virtually entirely nullified. This after 2003's St. Anger sounded horrific, and the band was roundly crucified...evidently nothing was learned. Oh, by the way, the new one debuted at number one...again.

Paramore are apparently in a studio in Nashville recording album numero tres. Good times!

Bayside and Crime In Stereo have both posted new music on their respective myspaces. Go listen!

Perhaps among my top-ten favourite bands ever, New Found Glory, after putting out an album with Bridge Nine earlier this year, have signed with California's Epitaph Records. Blink-182's Mark Hoppus will produce the band's label debut, due out next year. I'm so excited you have no idea.

Big Monday Night Football matchup tonight - Philly and Dallas! GO EAGLES!

Thoughts and prayers go out to our brothers and sisters in the Gulf Coast area, particularly cities like Houston and Galveston, Texas, as Ike finishes its damage and goes wherever storms wind up. To donate, either time or money, head to the Red Cross website or whatever your personal organization of choice is. But do something, even if it's just prayers.

The mayhem of Darkest Hour just took a hit: guitarist Kris Norris is out, leaving nothing but a terse statement: "Well, I'm not in the band anymore; see it how you want. Let's do no press statements, let's do no bullsh*t, let's just leave it what it is - I'm not in the band anymore, that's all. See you if I see you. I'm actively pursing some producing routes and any band that might want a guitarist, feel free. I haven't [put] off music totally, not just yet." Mike Carrigan was announced earlier today as Norris' replacement; Carrigan filled in with DH on their recent Thrash and Burn tour. The band will record their next album this fall with Brian McTernan - so it will sound doooope. Best of luck to Kris! [pastepunk]

Hot on the heels of my finishing Jeff Chang's masterful Can't Stop Won't Stop: A History of the Hip-Hop Generation(buy), another hip-hop book is coming down the pipe for me! Michael Eric Dyson, no slouch of an author himself, will curate a book about Nas' Illmatic record, an album that changed hip-hop in 1994, when Nasir Jones was all of nineteen years old. Born To Use Mics: Reading Nas' Illmatic wil analyze the entire record from an intellectual perspective. Dyson is a professor at Georgetown University, and previously wrote a book about Tupac called Holler If You Hear Me: Searching for Tupac Shakur. I'm super excited to get this one January 9th of next year. [Paste]

Former Saturday Night Live castmember and all-around hilarious dude Al Franken has followed in the foosteps of Jesse Ventura: he's made the jump from professional entertainer to professional politician. Franken won sixty percent of the vote in a recent Minnesota election to clinch his spot on the Democratic ticket; he'll run against the incumbent this fall. Go Al!

In a not-very-related story, Tina Fey is hot, even when she's impersonating Republican vice-presidential candidate Sarah Palin on SNL. Also, an actor/comedian Michael Phelps is not, as proved by his stint hosting SNL over the weekend. The Olympic uber-champion was about as wooden as it gets - certainly a far cry from Peyton Manning's awesome skit in which he beaned little kids in a United Way commercial spoof. Stay in the pool, homeskillet.

An update on Ye: rumours persist that Kanye's new record 808s & Heartbreak will hit stores December 16th - coincidentally, just in time for this here. Funny, that.

I still haven't seen the damn movie: rumours of a sequel to The Dark Knight have been shot down pretty much across the board...until one of the stars, the venerable Michael Caine, kinda-sorta confirmed the most persistent one to MTV.com: Johnny Depp as the Riddler, and Philip Seymour Hoffman(OMG) as the Penguin. Even though I've not made it out for this first film, I'm already making plans to attend that one. Hoffman has in fact denied rumours he was ever spoken to about the role when asked by reporters last week at the Toronto Film Festival.

The left coast's Demon Hunter are putting out a documentary in November called 45 Days, which will include three discs, a doc about the band and their fans, and a live set from Nashville. Every Time I Die performing at Urban Outfitters? Kinda. Singer Keith Buckley's side gig Finale can be seen here doing a song at an outlet in Buffalo. That is odd. By the way, ETID and Stick To Your Guns will be in Ottawa in November. [absolutepunk]

Poison the Well - this takes me way back, almost ten years...wow - are about halfway through the writing process for their next(guaranteed to blow minds) album. New guitarist Bradley Clifford had this to say earlier this week: "I don't know how to describe it... the closest comparison I have is saying it sounds like music made by a vampire crust punk wearing a cutoff jean jacket with spikes and a giant Crass patch on the back, headbanging to darkly romantic '50s music while on his way to the beach for a surf party." Sounds good to this observer. [lambgoat]

Another of my favourites from my youth, Most Precious Blood(Brooklyyyyyn!!), are also working up new material. They're calling it Do Not Resuscitate, aiming to have it in your hands in 2009, or whenever you find it online and steal it. Guitarist Justin Brannan: "The new record is one part systems-overload, one part Tragedy and one part funeral for a Mexican bullfighter." Where do these bands come up with this stuff??

Keeping with the oldschool: NYHC legends Vision of Disorder are ready to release a DVD that I will be first in line at my record store of choice to pick up. VOD broke up in 2002 after putting Long Island on the map, and the new project is called Dead In New York, due out November 11th...but the best part, at least for those of you who live in their stomping grounds(or are willing to take a roadie): VOD will play a hometown show five days later on the 16th at Irving Plaza in NYC to help usher in the new DVD. I gotta go! Also, there have been a lot of acronyms in this paragraph.

Still more '90s awesomeness! Earth Crisis, after a hugely-anticipated reunion tour that took them around the US and Europe, have decided to make their fanbase happy: they're back doing EC full-time, entering the studio next month to work on a new record. Century Media gets the honour of releasing it worldwide.

With the very tight-knit scene in their native greater Toronto area, I don't know how this didn't get out: Boys Night Out removed Connor Lovat-Frasor from the band a while back, and only this weekend officially announced his departure and that they've found their new singer. How 'bout that. Best of luck to all parties involved! Oh, wait. This might be a joke... [buzzgrinder]

Being a Canadian through and through, it's hard not to wish that two of my favourite things in life, metal and hockey, converged more often...WELL NOW THEY HAVE! The soundtrack for EA Sports NHL 2K9 title includes Protest the Hero(Canadian!), Genghis Tron, Mastodon and more! Hail the conquering heros!! Plus, the graphics I've seen in the trailers just look ridiculous. Who doesn't wanna be Rick Nash??

They might have sounded a little too close to Weezer with their earlier material, but power-popsters House of Heroes are still pretty damn good, and their new record The End Is Not the End is streaming over at Relevant's site. Buckets! For bullet wounds!

Today's Band Name o' the Day: JESUS H. CHRIST & THE HORNSMEN of THE APOCALYPSE. Classy.

They tour with their entire band, an extra support guy, and three dogs. Three! And now Fear Before the March of Flames have jettisoned most of their somewhat-unwieldy moniker - they're now known simply as Fear Before.

Underoath were in Toronto last week performing on MTV Canada; I missed it, but clips of several songs are up on everyone's favourite video website. [theprp]

Our friends at Tooth & Nail Records have a new website up and running. What do you think? I think they need to stop signing bands to replace Anberlin. No, in all seriousness, if a T&N kid exists, it's yours truly - going back to 1995. [IVM]

One of the straight-up best bands going today, Fair, are almost done album numero dos. Get excited, and if you're unfamiliar, check out some tunes!

All In are awesome. Barring the occasional bout of over-patriotism.

Robbers & Cowards was spectacular; let's see if Cold War Kids can better their debut album from 2006 with Loyalty to Loyalty, coming out this month! You can hear some snippets of new material over here.

Mark Townsend and JR McNeely, two heavyweights in the production/mixing scene, have gotten a couple buddies together for a Beatles cover band - awesome idea, says this observer. Check out their homage over here!

Say what you will about Pillar's latest two albums, but damn if Where Do We Go From Here doesn't still rock hard. We'll go now.

The family name may have been long besmirched by - among other things - molestation charges(he was acquitted) and 'wardrobe malfunctions' - but the Jackson Five reunited at an industry convention sans Michael this week in Los Angeles. Janet presented her bros with the lifetime-achievement BMI Icon Award, and while Jacko and his brother Jermaine were not present, their brother Marlon had the line of the night: when asked where Michael was, he responded, "I don't know - I think he's in Egypt riding a camel or something." Awesome. At the same event, T-Pain, who apparently owns the charts these days without my ever having heard his voice, was named the top songwriter. [R&R]

Seven Mary Three still write and record music. This would be the 7M3(acronyms!) that brought us 'Cumbersome,' which dominated rock radio in the Year of Our Lord 1995, and to which I still know all the lyrics.

They seem like they're really prolific - or rushed: Maylene & the Sons of Disaster will enter the studio in December to work on their third album, which they'll hopefully have out next summer. Didn't II just come out?? [Decoy]

The first guitar Hendrix ever set ablaze on stage was auctioned off this week for $128,000. The '65 Strat was burned at the stake - so to speak - in 1967.

Another '90s flashback for this post-Gen-Xer: Alice in Chains complete with new singer William DuVall(who?), are making a new record.

Tom Morello's new album is streaming online, so go get yourself some ear candy. The Rage guitarist spent his week, of course, in Minneapolis protesting at the Republican National Convention(see our last blog post for more on that).

A band that gives me chills: Keane have a new single online over here. I saw some HDNet made-for-TV concert of theirs a few years ago and they blew me away.

They kinda reminded me of Queens of the Stone Age crossed with Isis during their set at Ottawa's Bluesfest earlier this summer - in a good way. Brooklyn's Secret Machines are touring this fall with Canadian band The Dears Small Shins; check their myspace page for the deets.

Featuring ex-Taken guys(great band!), Mikoto played a tiny dive here in Ottawa a couple years ago, and besides commenting on my admittedly very old Eighteen Visions shirt, rocked a killer set...and then I never heard their name again - until now. Torque Recs in Saskatchewan have signed the band and will put out We Are the Architects October 14th. Good move!

As if The Loved Ones, MxPx and Hot Water Music's Chuck Ragan weren't awesome on their own, they're uniting for a tribute - to Johnny Cash, the Man in Black himself. It's called All Aboard!, due out before Christmas. PS: I've listened to little else but HWM's Caution record all week.

Word is that arguably the biggest MC in the world - if not the best - may have a new album out sooner rather than later - Kanye West is working on new material he could have out by the end of Oh Eight. [Billboard]

Nickelback have a new album coming out this fall. On that woeful day, feces will rain from the heavens upon all of us hapless citizens. And to make matters worse, U2's new album has been pushed back to 2009 by the Powers That Be. Dammit! There is a silver lining to this nickel-filled cloud, though: Bono and co. apparently have between fifty and sixty songs to choose from for inclusion on their first album in what will be five years.

I don't have to read past the pullquote on this story: one of the yowling voices of my youth, Chris Cornell(in his Soundgarden days), has a new album in November produced by...Timbaland. It's the clash of the titans! LOOK OUT!!!! My favourite quote from the piece: "As to be expected with Timbaland behind the boards, these songs move Cornell in a much more R&B-oriented direction..." Superb.

Proving there's still some semblance of hope in popular music, Slipknot's new single bumped The Game out of top spot on the Billboard 200 chart last week. Word to your mother.

One of the latest - and myriad - reasons why Rage Against the Machine are one of the most important bands around, and very welcome back in 2008: after their attempt to take the stage outside the Republican National Convention going on in Minnesota this week was stopped by police, the band simply did shit old-school - a capella!
