Interesting news out of Minnesota this fine Thursday evening: Judge Michael Davis has thrown out the verdict of first lawsuit won by the Recording Industry Association of America(RIAA), over 31-year-old Jammie Thomas, who the RIAA said stole song on Kazaa, blah blah blah. The judge determined that he "erred in instructing jurors how to decide if" the defendant had done as claimed, and that she deserved a new trial. This decision could make things much more difficult for the majors as they bumble and stumble along like dinosaurs, trying desperately to impede the inevitable. Poison the Well - who have never made the same record twice, and somehow have never made a bad record, period - have picked J. Robbins of Jawbox fame to help them craft their newest album. Robbins has been behind the glass for Modern Life Is War, Paint It Black and numerous others. The record should be out May of next year.

Everyone's favourite Metallica-worship band Trivium have posted their new record Shogun on their myspace page. Also, I can't turn on my television to MuchLoud without seeing spots for the record.

Man, I hope this tour comes to town: Madball and Suicidal Tendencies will tour together in December, though ST haven't released new material in almost a decade. Clearly, a new Suicidal album is in the offing.

The band who brought you Where Blood and Fire Bring Rest ten years ago are working on a new album: the legendary, massively-influential Zao are recording new music with Tim Lambesis of As I Lay Dying and producer Daniel Castleman. Guitarist Scotty Mellinger says, "We haven't been on the road since the Demon Hunter and Throwdown tours in 2006, which has given us plenty of time to get our wits about us and to really concentrate on creating the best batch of material we possibly can." The new album will be put out by Ferret in 2009. I have a signed poster from the Liberate tour a decade ago. Zao are awesome. The end.

Something I have to get off my chest: last night I went out to see Bury Your Dead, For the Fallen Dreams and A Ghost Inside on their current tour, and sadly BYD were unable to play, having had a horrific van/trailer accident fifteen minutes outside Ottawa after crossing the Canadian border. A couple members made it out to the show; the rest were in hospital with injuries ranging from lacerations to a broken leg. FTFD and AGI were class acts, every last one in Bury Your Dead gear onstage and selling the band's merch in their stead. A terrible incident, all things considered, and then made worse by this, from an industry news/gossip site, which summarizes the unfortunate events of yesterday, followed by dozens of comments from teenaged children who have never seen suffering, have never seen pain, and obviously have never seen anything but their parents' basement, judging by the intellect and raw, ignorant hatred displayed in the mocking posts. Hey, kids - a message from someone who even at your age, with all of your imperfections and lack of perspective, never acted as you did: f*** you, brat squad. We'll see who's laughing when it's your ass in a sling in hospital somewhere after something like this happens to you. Oh yeah - the rest of us. Best wishes to BYD as they overcome(and they will) this obstacle in their journey.
